This privacy policy (“Privacy Policy”) applies to any websites that we own and control, such as https://www.magidglove.com/ and any related products and services we may offer to you, including any website or mobile application, that posts a link to this Privacy Policy, and any interactive features, widgets, plug-ins, applications, content, downloads and other services that we may own and control and make available through any websites that we own and control (collectively, the “Website”), regardless of how you access or use them, whether via personal computer, browser, laptop, tablet, mobile phone or other device (each a “Device”). This Privacy Policy covers how Magid collects, uses, shares, and processes personal and other information and data of users of the Website. In addition, as required by the Illinois Biometric Information Privacy Act, this Privacy Policy provides Magid’s retention schedule for any Biometric Data collected from our team members who reside in the State of Illinois. To the extent that we provide you with notice on the Website of different or additional privacy policies or practices (e.g. at the point of collection), those additional privacy policies shall govern such data collection and use.

By using or accessing the Website or by submitting information to Magid, you consent to the terms of this Privacy Policy.

In addition to reading this Privacy Policy, please review our Terms of Use, which governs your use of the Website. IF YOU DO NOT AGREE TO OUR TERMS OF USE AND THE COLLECTION, USE AND SHARING OF YOUR INFORMATION AS DETAILED IN THIS PRIVACY POLICY, PLEASE DO NOT ACCESS OR OTHERWISE USE THIS WEBSITE OR ANY INFORMATION OR CONTENT CONTAINED ON THIS WEBSITE.

We reserve the right to change this Privacy Policy at any time and we will post notice or inform you of any such changes on our Website. Your use of the Website following the posting of an updated Privacy Policy constitutes your acceptance of such updated Privacy Policy. We reserve the right to apply the amended terms to the information that we have already collected, subject to any legal constraints. We will not, however, use your previously collected Personal Information in a manner materially different than represented at the time of collection. To the extent any provision of this Privacy Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.

Please note that this Privacy Policy applies only to our information-gathering, use, and dissemination practices in connection with our Website. This Privacy Policy does not apply to any of our information practices conducted separately by Magid outside of the Website.

This Privacy Policy is written in the English language. We do not guarantee the accuracy of any translated versions of this Privacy Policy. To the extent any translated versions of this Privacy Policy conflict with the English language version, the English language version of this Privacy Policy shall control.

1. Information Collection.

We collect information from you in several ways, including when you choose to share information with us by entering it through our Website, and by using automated processes. We also collect information about your transactions with us, such as when you order our products through our Website or through third-party storefronts where we sell our products, such as Ebay.com.

(a)     Information You Provide.

We may ask you and you may choose to provide certain “Personal Information” to us, which is information that identifies you personally, such as your first and last name, e-mail address, payment information, mailing and billing addresses, and telephone number. Please note that we use a third-party payment processor so we do not store information about your payment card when you submit online payment. If you call us over the phone and provide your payment information, we do not store that information, but promptly pass it on to our third-party payment processor. We may collect Personal Information in a variety of places, including when you contact us directly, through third-party storefronts, and through our Website.  You should review the privacy policies of those third-parties to understand how they collect and use information.

(b)    Automated Information Collection.

In addition to any information that you choose to submit to us via the Website, we and our third-party service providers may use a variety of technologies that automatically (or passively) store or collect certain information whenever you visit or interact with the Website (“Usage Information”). This Usage Information may be stored or accessed using a variety of technologies that may be downloaded to your Device whenever you visit or interact with our Website. To the extent that we associate Usage Information with your Personal Information that we collect directly from you on the Website, we will treat that Usage Information as Personal Information.

This Usage Information may include:

• Your IP address, UDID or other unique identifier (“Device Identifier”). A Device Identifier is a number that is automatically assigned to your Device used to access the Website.  Our computers identify your Device by its Device Identifier;
• Your Device functionality (including browser, operating system, hardware, mobile network information);
• The URL that referred you to our Website;
• The areas within our Website that you visit and your activities there, including remembering you and your preferences;  
• Your Device location;
• Your Device characteristics; and
• Certain other Device data, including the time of day, among other information

Tracking Technologies. We may use various methods and technologies to store or collect Usage Information (“Tracking Technologies”). Tracking Technologies may set, change, alter or modify settings or configurations on your Device. A few of the Tracking Technologies include, without limitation, the following (and subsequent technology and methods later developed):

A Flash cookie (or locally shared object) is a data file placed on a Device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device. ETag, or Entity Tag. A feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner, ETags are a form of Device Identifier. ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash, and/or HTML5 cookies.

4.  Information Protection.

We use commercially reasonable and industry standard security technologies and safeguards to protect the information that we collect and use. For example, we utilize a PCI-certified service provider to process payment card payments. We also expect our service providers to protect information in the same manner. However, no data transmission over the Internet, mobile networks, wireless transmission or electronic storage of information can be guaranteed 100% secure. Please note that we cannot guarantee the security of any information you transmit to us.

 

5. Changing Information and Communication Preferences.

You are responsible for maintaining the accuracy of the information you submit to us. The Website may allow you to review, correct or update Personal Information you have provided through the Website’s forms or otherwise. When you edit your Personal Information or change your preferences on the Website, information that you remove may persist internally for our administrative purposes. 7. Children’s Privacy.

Our sites and applications are intended for general audiences, and we do not knowingly seek or collect personal information from children under the age of eighteen (18). In accordance with the Children’s Online Privacy Protection Act, in the event that we learn that we have collected personal information from a child under age thirteen (13) without verification of parental consent, we will delete that information as quickly as possible. 8. U.S. State Privacy Rights

D. Right to Appeal. If we decline to take action regarding your request, we will inform you of our decision and the reasoning behind it. If you reside in certain states (including Colorado, Connecticut, Montana, Oregon, Texas, or Virginia) and you wish to appeal our decision, you may do so by contacting us at service@magidglove.com with the subject line "Privacy Appeal."

E. "Selling" and "Sharing" of Personal Information. Under certain State Privacy Laws, the use of tracking technologies (such as cookies and pixels) for analytics and targeted advertising may be considered a "sale" or "sharing" of personal data, even if no money is exchanged.

• Categories of Personal Information Sold/Shared: We may share identifiers (like IP addresses and device IDs) and internet activity with third-party advertising networks, analytics providers, and social media platforms.
• Opt-Out Preference Signals: We recognize the Global Privacy Control (GPC) as a valid request to opt out of the sale or sharing of your personal information.   F. Sensitive Personal Information. We do not use or disclose "Sensitive Personal Information" (as defined by applicable State Privacy Laws) for the purpose of inferring characteristics about you. Any collection of Biometric Data is governed strictly by our retention schedule outlined in Section 9 and applicable Illinois law.

 10. Notice to Residents of Mexico 

This section applies solely to personal data subjects located in Mexico and supplements our Privacy Policy to comply with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations.

A. Identity and Domicile of the Data Controller. Magid Glove & Safety Manufacturing Company LLC (“Magid”), with an address at 1300 Naperville Drive, Romeoville, IL 60446-1043, USA, is responsible for the processing and protection of your personal data.

B. Purposes of Processing. Your personal data will be used for the following purposes, divided into Primary and Secondary categories:

• Primary Purposes (Necessary): To verify your identity; to process your orders and payments; to ship products to your address; to issue invoices (CFDI); to handle returns, warranties, or customer service requests; and to comply with legal obligations. You cannot opt out of these purposes if you wish to use our services.
• Secondary Purposes (Voluntary): To send you marketing communications, newsletters, and surveys; to invite you to events or contests; and to evaluate the quality of our service. You have the right to refuse the use of your data for these secondary purposes

Refusal Mechanism: If you do not wish for your data to be used for Secondary Purposes, you may indicate this at the time of data collection or request it subsequently by emailing us at service@magidglove.com with the subject line "Refusal of Secondary Purposes." Refusal to use your data for these purposes will not be a reason for us to deny you our products or services.

C. ARCO Rights. You have the right to Access, Rectify, Cancel, or Oppose the processing of your personal data ("ARCO Rights"):

• Access: To know what personal data we have about you, what we use it for, and the conditions of use.
• Rectification: To request correction of your personal information if it is outdated, inaccurate, or incomplete.
• Cancellation: To request that we remove your information from our records or databases when you consider it is not being used in accordance with the principles, duties, and obligations provided under the law.
• Opposition: To oppose the use of your personal data for specific purposes.

To exercise any of these rights, please submit a request to our Privacy Department at service@magidglove.com. Your request must contain: (i) your name and domicile; (ii) documents proving your identity (e.g., passport, INE); (iii) a clear description of the personal data and the right you wish to exercise; and (iv) any other element that facilitates the location of the data.

D. Data Transfers. Your personal data may be transferred to and processed in the United States. By providing your data, you consent to this international transfer as necessary for the performance of the contract (i.e., fulfilling your order).

E. Limiting Use or Disclosure. In addition to exercising your ARCO rights, you may limit the use or disclosure of your personal data by enrolling in the Public Registry to Avoid Advertising (REPEP) managed by PROFECO

 

11.  Information for Illinois Team Members

Consistent with the Illinois Biometric Information Privacy Act, Magid provides the following information to our Illinois team members concerning our retention of any Biometric Identifiers and Biometric Information (collectively, “Biometric Data”):

• All Biometric Data will be permanently destroyed after the initial purpose for collecting or obtaining the Biometric Data has been satisfied or within three years after your employment with the Company terminates, whichever occurs first.
• To the extent permitted by applicable law or court order, the Company will suspend the destruction of Biometric Data when, and to the limited extent, necessary to satisfy the Company’s duty to preserve information that would be discoverable in litigation.
